Former Morro Bay Dispensary Operator Will Not Get New Trial |

The man who ran a marijuana dispensary in Morro Bay will not be getting a new trial.
Monday, a judge in Los Angeles denied Charles Lynch's request.
Lynch was convicted on five federal charges connected to the operation of the Central Coast Compassionate Caregivers facility. The dispensary was raided in July of 2007.
While California law allows the distribution of marijuana for medical reasons, federal law does not.
Lynch's sentencing is scheduled for February 23. Lynch said he plans to do everything he can to fight the charges.
"Obviously, we intend to appeal whatever kind of sentence I get," Lynch told Action News in a phone interview.... [Read More]

If you think budget cuts at your job suck (New Times is a considering a writing-by-candlelight, tent-office setup) try being a Miami-Dade public defender. Thanks to shrinking state court funds - down in 44 million in the past two years - these burnt-out servants of the poor, tired, huddled masses are crunching about 500 cases each at any given moment. (Four times as many as Broward PDs.)
With a 16 percent caseload increase in the past eight months, crime is going up as lawyers are dropping out. So it doesn't go over well when the opposition starts offering a few friendly penny-pinching pointers for the new year.

Smoking a joint may become illegal again in Milford, even though new state law says it's not.
Selectmen voted unanimously last night to have Town Meeting consider a bylaw that would make consuming marijuana on public property a criminal offense.
"I think it's a good idea," said Selectman Brian Murray.
Police Chief Thomas O'Loughlin told the board he supports the idea, which he likened to a town bylaw that prohibits drinking in public.
Under a state law that went into effect last week, possession of an ounce of less of marijuana is now a civil offense.

The draft rules for the state's medical marijuana program treat users as criminals and put undue responsibility on law enforcement, say those who spoke at the only public hearing on the topic Monday in Lansing.
More than 100 people gathered to voice concerns about regulations drawn by the Michigan Department of Community Health, which will oversee the program starting April 4.
Among the issues raised were possible constitutional and privacy violations, as well as what some advocates say is a too-narrow definition of "public place," where medical marijuana use would still be illegal.

Appeal Court Orders New Trial For Island Man In Grow-op Case |

A new trial has been ordered for a Courtenay man convicted of operating a marijuana grow-op.
In January, Gia Hung Vi was convicted of one count of unlawfully producing a controlled substance and one count of possessing marijuana for the purpose of trafficking.
He appealed, arguing that the provincial court judge who heard the case was wrong to dismiss his application to cross-examine police about a search warrant.
RCMP executed the warrant in April 2006 and found the grow-op at a home on McLauchlin Drive in Courtenay.

A former Winsted man who gained notoriety several years ago when he protested his arrest on marijuana charges by painting giant marijuana leaves on his house appeared briefly in Bantam Superior Court on Monday for a hearing about medical treatment he will undergo so that he might be deemed competent to stand trial on new drug charges.
Christopher Seekins, 28, was granted a suspended prison sentence in 2006 and placed on probation after Winsted police found 100 thriving marijuana plants in his home on High Street. He was re-arrested in 2007 by Torrington police, who found marijuana growing in his home on Gleeson Street in Torrington.

An activist is suing San Bernardino County for refusing to issue state-mandated medical marijuana cards.
The Superior Court lawsuit filed Monday by Scott Bledsoe seeks enforcement of California's voter-approved Proposition 215, which allows physician-approved marijuana use.
The proposition collides with federal drug laws.
In 2003, the Legislature provided additional legal guidance to medical marijuana users and led to dispensaries opening in California. Counties were ordered to issue medical marijuana identification cards.

Tempers were flaring and opinions were flying as advocates of medical marijuana use pushed for to revisions to the rules.
While voters approved the limited use of medical marijuana for certain conditions back in November many are now saying the list is too exclusive.
One proponent argues, "if you have this condition you can live, if your condition is not on the list you're required by law to die because you can't get this medicine."
Others argue that the rules, which say that medical marijuana must be stored in a locked and closed facility, take it too far.

Three New York City police officers were indicted in early December for the alleged sodomy of a 24-year-old tattoo artist, after the man was arrested for allegedly smoking marijuana outside of a Brooklyn subway station.
Richard Kern, 25, a four-year veteran, is charged with the most serious crime of using a baton to violate Michael Mineo in October. Officers Alex Cruz and Andrew Morales were indicted on the charge that they tried to cover up the sodomy.
The Rev. Al Sharpton, of the National Action Network, was the first civil rights leader to appear at Mr. Mineo’s side—even as the police department’s Internal Affairs Division and the media said there was no sodomy.

A spokesman for the Michigan State Police said the department does not want the responsibility of destroying excess medical marijuana, as written in the draft rules being discussed today in Lansing.
Greg Zorotney of the State Police executive division said a better solution would be for users or caregivers to destroy excess supply or for the Michigan Department of Community Health to write rules allowing for the transfer of medical marijuana from a retired user to a new user.
